INSTOLLAR LLC'S TERMS OF SERVICE

INTRODUCTION

Welcome to instollar.com. The following terms of service oversee your access to and use of the Instollar LLC platform and mobile application, including any content, function, and services offered on or through www.Instollar LLC.com or the Instollar LLC mobile application (coming soon) by Instollar LLC ( 201 N Mcdowell St, 30786, Charlotte NC 28204, United States).

Please read the Terms of Service carefully before you start to use the platform. By using the platform, opening an account, or clicking to accept or agree to the Terms of Service when this option is made available to you, you accept and agree, on behalf of yourself or on behalf of your employer or any other entity (if applicable), to be bound and abide by these Terms of Service and Instollar LLC Payment Terms, found in our Prices and Payments page, which is incorporated herein by reference. You further acknowledge you have read and understood our Privacy Policy, found here. If you do not want to agree to these Terms of Service or the Privacy Policy, you must not access or use this platform. For more detailed policies surrounding the activity and usage on the platform, please find and scrutinize the designated articles on this page.

Instollar LLC is available to users who are at least 18 years of age and legal age to form a binding contract. If you are under 18 you are not permitted to use Instollar LLC whether or not you are doing it through an account owned by a parent or legal guardian with their appropriate permission. By using Instollar LLC, you represent and warrant that you meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use Instollar LLC.

Our Customer Support team is available 24/7 if you have any questions regarding the Site or Terms of Service. Contacting our Customer Support team can be performed by sending an email to [email protected].

The original language of these Terms of Service, as well as all other texts throughout the Site, is English. Instollar LLC makes this translation available for convenience only. In case of conflicts between the original English version and any translation, the English version shall prevail.

KEY TERMS
  1. Freelancers are users who offer and perform services on Instollar LLC.
  2. Solar Companies are users who purchase services on Instollar LLC.
  3. Users refer to both Freelancers and Solar Companies
  4. Custom Offers are requests made by a Solar Company to receive a Custom Offer from a Freelancer.
GENERAL OVERVIEW

Only registered freelancers may display their talents on Instollar LLC. Registration is free. In registering for an account, you agree to provide us with accurate, complete, and updated information and must not create an account for fraudulent or deceptive purposes.

You are solely responsible for any activity on your account and for maintaining the confidentiality and security of your password. We are not liable for any acts or omissions by you in connection with your account.

  • Services on Instollar LLC may be offered according to the terms expressly stated on the Platform. Several skills are featured on the Platform, and these skills and prices have been listed and explained accordingly on our Prices and Payments page
  • Companies pay Instollar LLC in advance to create an order (refer to Prices and Payments page).
  • Hires are made through the hire button found on a Freelancers page or through a Custom Offer.
  • For fees and payments please read the Prices and Payments page.
  • Freelancers must fulfill their orders, and may not cancel orders regularly or without cause. Cancelling orders will affect Freelancers’ reputation and status.
  • Freelancers gain account statuses (Levels) based on their training badges, certificates, performances, and reputation.
  • Users of Instollar LLC may not offer or accept payments using any method other than placing an order through Instollar LLC.
  • When hiring a Freelancer, Solar Companies are granted all rights for the delivered work, unless otherwise specified by the Installer on their page.
  • We care about your privacy. You can read our Privacy Policy.
COMPANIES
Overview
  • You may not offer direct payments to any worker / freelancer using payment systems outside of the Instollar LLC platform.
  • Instollar LLC retains the right to use all publicly published delivered works for Instollar LLC marketing and promotional purposes reviews.
  • Feedback reviews provided by Companies after completing an Order are an essential part of Instollar rating system. Reviews demonstrate the Company's overall experience with the freelancer and their service. Companies are encouraged to communicate to the freelancer any concerns experienced during their active order regarding the service provided by the freelancer.
  • Leaving a Company's feedback is a basic prerogative of a Company. Feedback reviews will not be removed unless there are clear violations of our Terms of Service and/or our Community Standards.
  • To prevent any misuse of our Feedback system, all feedback reviews must come from legitimate project exclusively completed through the Instollar platform.
  • Purchases arranged, determined to be artificial for the purpose of enhancing Freelancer ratings, or to abuse the Instollar platform, will result in a permanent suspension of all related accounts.
  • Users are allowed to leave reviews on Orders up to 15 days after an Order is marked as complete. No new reviews may be added to an Order after 15 days.
  • Once the Company submits his/her review, the Freelancer will receive a notification and will also have the opportunity to leave a review about working with the Company. Please Note: At this stage, Freelancers cannot see the Company's review.
  • Once both Freelancer and Company have completed their reviews, or the 15 days have passed, all posted reviews are made public.
  • Responding to a review: Once both reviews from the Company and Freelancer have been published, the Freelancer can reply to the Company’s review from the Order page, seen on the Freelancer’s profile page, beneath the Company’s feedback.
FREELANCERS
Overview
  • Freelancers create pages on Instollar LLC to allow Solar Companies hire their services.
  • Freelancers may also offer Custom Offers to Solar Companies in addition by stating the same on their page.
  • Each service you offer and successfully complete, accredits your account with a revenue equal to terms stated in our Prices and Payments page into bank account provided by you.
  • Instollar LLC accredits Freelancers once an order is completed.
  • For more information about receiving payments, fees and taxes see the Prices and Payments page.
  • Freelancers may not promote their pages or any Instollar LLC content via the Google Ads platform.
  • The Freelancer’s rating is calculated based on the hire reviews posted by Solar Companies, as well as Instollar LLC trainings they have undertaken and badges they have received. High ratings allow Freelancers to obtain advanced levels. In certain cases, exceedingly low ratings may lead to the suspension of the Freelancer’s account.
  • For security concerns, Instollar LLC may temporarily disable a Freelancer’s ability to withdraw revenue to prevent fraudulent or illicit activity. This may come as a result of security issues, improper behavior reported by other users, or associating multiple Instollar LLC accounts to a single withdrawal provider.
  • Freelancers are responsible for obtaining a general liability insurance policy with coverage amounts that are sufficient to cover all risks associated with the performance of their services.
Levels

Levels on Instollar LLC dictates the status of a Freelancer on the Platform and also influences prices attributed to their services on Instollar LLC. This means, the higher a Freelancer’s level, the higher they are paid for services rendered.

Levels change based on the work done on the Platform such as trainings taken, projects completed and customer service indicated by review rating on Freelancer’s page. If Freelancers deliver on time, render high quality service and ratings, and take trainings on the Platform, Instollar LLC may reward them with new statuses, special opportunities, benefits, and tools that come with it.

  • Freelancers level are based on merit. There are three levels for Freelancers on Instollar LLC:
    • Level 1 – Beginner: This level is the first stage upon registration onto Instollar LLC. At this stage, there are no training badges, certificates or reviews on the Freelancer’s page.
    • Level 2 – Intermediate: After Freelancer completes two trainings and has undertaken one project with a positive review, Freelancer moves to Level two.
    • Level 3 – Advanced Level: Upon completion of all available trainings on the Platform, undertaking seven projects with a total of 4.5 reviews, Freelancer page moves to Level 3.
  • Levels may be degraded by Instollar LLC from the Platform for violations of these Terms of Service and/or our Community Standards, which may include (but are not limited to) the following violations and/or materials:
    • Illegal or Fraudulent services
    • Incorrect personal information
    • Forged proof of projects
    • Misleading information to Solar Companies or others
    • Fraglant disrespect for rules and guidelines
    • Poor/unsatisfactory service rendered to Solar Companies
    • Exceedingly low-quality services
    • Any other action that is deemed to go against Community Standards
Projects

Instollar LLC is all about helping Freelancers leverage their skills. We seek to empower top performing Freelancers with helpful tools to grow their business. Freelancers who invest in self-promotion may achieve greater customer satisfaction. Instollar LLC Freelancers can gain account Levels based on their activity, performance, and reputation.

Projects on Instollar LLC are grouped into types:

  • Residential Installation
  • Industrial Installation
  • Mini Grids
  • Micro Grids

Freelancers will choose whichever installation they have experience with as they register, so Solar Companies will engage as appropriate.

Skills

Instollar LLC is all about helping Freelancers leverage their skills. We seek to empower top performing Freelancers with helpful tools to grow their business. Freelancers who invest in self-promotion may achieve greater customer satisfaction. Instollar LLC Freelancers can gain account Levels based on their activity, performance, and reputation.

Skills on Instollar LLC are grouped into types:

  • Solar Technicians
  • Solar Engineers
  • Design Engineers
  • Commissioning Engineers
  • Project Managers

Freelancers will choose whichever skill(s) they want to identify with on Instollar LLC as they register, so Solar Companies will engage as appropriate.

Custom Offer
  • Freelancers can also upload Custom Offers addressing the specific skills and value they can render for Solar Companies on their project.
  • Custom Offers are defined by the Freelancer with the exact description of the service, the price, and the time expected to deliver the service.
  • Custom Offers are uploaded on the Freelancer’s page.
  • Services provided through Custom Offers may not violate Instollar LLC’s Terms of Service and/or our Community Standards.
Reviews
  • Feedback reviews provided by Companies while completing an Order are an essential part of Instollar LLC's rating system. Reviews demonstrate the Company's overall experience with the Freelancers and their service. Companies are encouraged to communicate to the Installer any concerns experienced during their active order regarding the service provided by the Installer.
  • Leaving a Company's feedback is a basic prerogative of a Company. Feedback reviews will not be removed unless there are clear violations of our Terms of Service and/or our Community Standards.
  • To prevent any misuse of our Feedback system, all feedback reviews must come from legitimate sales executed exclusively through the Instollar LLC platform from users within our Community. Purchases arranged, determined to artificially enhance Installer ratings, or to abuse the Instollar LLC platform with purchases from additional accounts, will result in a permanent suspension of all related accounts.
  • Feedback comments given by Companies are publicly displayed on a Freelancer’s page.
  • Work Samples are the delivered images and videos sent to a Company in a delivery message. Work Samples are added to a Freelancer’s Live Portfolio on their page if the Company chooses to publish the Work Sample while providing a public feedback review.
  • Withholding the delivery of services, files, or information required to complete the service with the intent to gain favorable reviews or additional services is prohibited.
  • Responding and posting a review: Once work is delivered, the Company has three days to respond. If no response is provided within the response period, the Order will be considered completed.
  • Users are allowed to leave reviews on Orders up to 10 days after an Order is marked as complete. No new reviews may be added to an Order after 10 days.
  • Freelancers may not solicit the removal of feedback reviews from their Companies through mutual cancellations.
  • Once the Company submits his/her review, the Installer will receive a notification and will also have the opportunity to leave a review about working with the Company. Please Note: At this stage, Freelancers cannot see the Company's review.
  • Once both Installer and Company have completed their reviews, or the 10 days have passed, all posted reviews are made public.
  • Responding to a review: Once both reviews from the Company and Installer have been published, the Installer can reply to the Company’s review from the Order page, seen on the Freelancer’s page, beneath the Company’s feedback.
Disputes and Cancellations

Companies and Freelancers with disputes can contact Instollar LLC's Customer Support department for assistance [email protected]. For more information about disputes, Order cancellations, and refunds please refer to the Prices and Payments page.

User Conduct and Protection

Instollar LLC enables the African workforce to earn income through freelancing . Services offered on Instollar LLC platform reflect the diversity of an expanding Gig economy.

Instollar LLC maintains a friendly, community-spirited, and professional environment. Users should keep to that spirit while participating in any activity or extension of Instollar LLC. This section relates to the expected conduct users should adhere to while interacting with each other on Instollar LLC.

To report a violation of our Terms of Service and/or our Community Standards, User Misconduct, or inquiries regarding your account, please contact our Customer Support team at [email protected].

Orders
  • Users to defame competing Freelancers by ordering from competing services will have their reviews removed or further account status-related actions determined by review by our Trust & Safety team.
  • Users are to refrain from spamming or soliciting previous Companies or Freelancers to pursue removing/modifying reviews or canceling orders that do not align with Order Cancellation or Feedback policies.
Reporting Violations

If you come across any content that may violate our Terms of Service and/or our Community Standards, you should report it to us through the appropriate channels created to handle those issues as outlined in our Terms of Service. All cases are reviewed by our Trust & Safety team. To protect individual privacy, the results of the investigation are not shared. You can review our Privacy Policy for more information.

Violations

Users may receive a warning to their account for violations of our Terms of Service and/or our Community Standards or any user misconduct reported to our Trust and Safety team. A warning will be sent to the user's email address and will be displayed for such a user on the Site. Warnings do not limit account activity but can lead to your account losing Freelancer statuses or becoming permanently disabled based on the severity of the violation.

Feedback Rights

To the extent that you provide Instollar LLC with any comments, suggestions or other feedback regarding the Instollar LLC platform or the Site as a whole, as well as other Instollar LLC products or services (collective, the “Feedback”), you will be deemed to have granted Instollar LLC an exclusive, royalty-free, fully paid up, perpetual, irrevocable, worldwide ownership rights in the Feedback. Instollar LLC is under no obligation to implement any Feedback it may receive from users.

Confidentiality

Freelancers should recognize that there might be a need for Companies to disclose certain confidential information to be used by Freelancers for the purpose of delivering the ordered work, and to protect such confidential information from unauthorized use and disclosure. Therefore, Freelancers agree to treat any information received from Companies as highly sensitive, top secret and classified material. Without derogating from the generality of the above, Freelancers specifically agree to (i) maintain all such information in strict confidence; (ii) not disclose the information to any third parties; (iii) not use the information for any purpose except for delivering the ordered work; and (vi) not to copy or reproduce any of the information without the Company’s permission.

General Terms
  • Instollar LLC reserves the right to put any account on hold or permanently disable accounts due to a breach of these Terms of Service and/or our Community Standards or due to any illegal or inappropriate use of the Site or services.
  • Violation of Instollar LLC's Terms of Service and/or our Community Standards may get your account disabled permanently.
  • Users with disabled accounts will not be able to sell or buy on Instollar LLC.
  • Users who have violated our Terms of Service and/or our Community Standards and had their account disabled may contact our Customer Support team for more information surrounding the violation and status of the account.
  • Users have the option to enable account Security features to protect their accounts from any unauthorized usage.
  • Users must be able to verify their account ownership through Customer Support by providing materials that prove ownership of that account.
  • Disputes should be handled using Instollar LLC's dispute resolution tools ('Resolution Center' on the order page) or by contacting Instollar LLC Customer Support.
  • Instollar LLC may make changes to its Terms of Service from time to time. When these changes are made, Instollar LLC will make a new copy of the terms of service available on this page.
  • You understand and agree that if you use Instollar LLC after the date on which the Terms of Service have changed, Instollar LLC will treat your use as acceptance of the updated Terms of Service.
Disclaimer of Warranties

YOUR USE OF THE PLATFORM, ITS CONTENT, AND ANY SERVICES RENDERED THROUGH THE PLATFORM IS AT YOUR OWN RISK. THE PLATFORM, ITS CONTENT, AND ANY SERVICES RENDERED THROUGH THE PLATFORM ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER INSTOLLAR LLC NOR ANY PERSON ASSOCIATED WITH INSTOLLAR LLC MAKES ANY WARRANTY OR REPRESENTATION CONCERNING THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY OR AVAILABILITY OF THE PLATFORM.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Limitation on Liability

IN NO EVENT WILL INSTOLLAR LLC, ITS AFFILIATES OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE PLATFORM, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE PLATFORM OR SUCH OTHER WEBSITES OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE INSTOLLAR LLC PLATFORM OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

The term “Affiliate” referred to herein, is an entity that, directly or indirectly, controls, or is under the control of, or is under common control with Instollar LLC, where control means having more than fifty percent (50%) voting stock or other ownership interest or the majority of voting rights of such entity.
